INFORMATION PROVIDED PURSUANT TO ART. 13 OF EU REGULATION 2016/679 (GDPR)

This information is provided pursuant to EU Regulation 679/2016 and subsequent national implementing legislation (hereinafter collectively “GDPR”) and describes how SPRECH SRL (“Data Controller”) collects and processes the personal data of its customers through its website, www.sprech.com.

The term “personal data” means any information relating to an identified or identifiable natural person. For example, personal data includes name, identification number, location data, and online identifier.

The data collected is processed in accordance with the principles of fairness, lawfulness, transparency, and protection of your privacy and rights.

Data processing is carried out using manual, electronic, and IT methods; security measures are adopted to prevent the risks of unauthorized access, destruction or loss, unauthorized processing, or processing not in accordance with the purposes of collection.

The provision of personal data is mandatory only for data strictly necessary to establish the relationship for the supply of products and services provided by Sprech Srl.

Sprech Srl may periodically modify, supplement, or update this Information Notice, also in consideration of any changes to applicable legislation or measures by the Data Protection Authority. Substantial modifications and updates to the Privacy Policy will be applied and brought to the attention of data subjects as soon as they are adopted by updating the link to the Privacy Policy in the footer of the Site and by email communication to registered users. In the event of changes that significantly affect the rights of registered users, communication will be made with reasonable advance notice.

1. CATEGORIES OF PERSONAL DATA PROCESSED
1.1 Below is a description of the categories of data we process:

Data provided directly by the data subject: all personal data entered on the Site through registration on the dedicated page: https://sprech.com/area-riservata.html (to proceed with online purchases or to register), or otherwise provided to Sprech so that it can fulfill its obligations.
Examples of data provided directly by potential customers include: name; address and telephone number. More generally, all data provided to enable the placement of a purchase order and the sending of newsletters, delivery of products with communication of contact numbers or addresses (e.g., telephone, email, addresses), participation in events, etc.

Data provided by third parties: all personal data that Sprech collects from other sources (e.g., postal service companies, couriers) to perform its services.
Automatically collected data: browsing data and/or data collected through so-called “cookies.”

2. PURPOSE AND LEGAL BASIS OF PROCESSING
2.1 The data provided is processed for the following purposes:

compliance with legal obligations;
sending informational and promotional communications related to the outdoor world, subject to consent;
sending by Sprech Srl of commercial communications relating to its products and services;
The legal basis of processing is registration on the site and/or newsletter. This then allows the establishment of the commercial relationship between Sprech and the consumer user.

2.2 For the performance of the contract and compliance with legal obligations, Sprech Srl may communicate personal data to the following categories of subjects:

subjects who perform technical and organizational services on behalf of Sprech Srl;
firms, consultants, and companies within assistance and consultancy relationships;
public authorities, where applicable.
These subjects will process data as Joint Data Controllers or Data Processors on behalf of Sprech Srl.

3. DURATION OF PROCESSING AND RETENTION PERIOD
Data will be processed only for the time necessary for the purposes listed.

Below are the periods of use and retention of personal data with reference to the different processing purposes:

data processed for compliance with legal obligations will be retained by Sprech Srl within the limits provided by law;
data will be processed for sending informational, institutional, and promotional communications until any revocation of consent given for this purpose;
data entered in the “Work with us” section will be retained for a maximum period of 12 months, in order to allow evaluation of the profile against company needs.

4. RIGHTS OF ACCESS, ERASURE, RESTRICTION, AND PORTABILITY
Data subjects are granted the rights referred to in Articles 15 to 20 of the GDPR. By way of example, each data subject may:
  • obtain confirmation as to whether or not personal data concerning them is being processed;
  • where processing is underway, obtain access to personal data and information relating to the processing as well as request a copy of the personal data;
  • obtain rectification of inaccurate personal data and completion of incomplete personal data;
  • obtain, where one of the conditions provided for in Article 17 of the GDPR exists, erasure of personal data concerning them;
  • obtain, in the cases provided for in Article 18 of the GDPR, restriction of processing;
  • receive personal data concerning them in a structured, commonly used, and machine-readable format and request their transmission to another controller, if technically feasible.
5. RIGHT TO OBJECT

Each data subject has the right to object at any time to the processing of their personal data carried out for the pursuit of a legitimate interest of the Controller. In the event of objection, their personal data will no longer be subject to processing, unless there are legitimate grounds for processing that override the interests, rights, and freedoms of the data subject or for the establishment, exercise, or defense of legal claims.

6. RIGHT TO WITHDRAW CONSENT

6.1 In the event that consent is required for the processing of personal data, each data subject may also withdraw at any time consent already given. Consent may be withdrawn by writing an email to the address indicated on the site in the “Privacy” section.

6.2 Right to object and withdraw consent in relation to processing carried out for marketing purposes

6.3 With reference to the processing of data for marketing purposes referred to in the paragraph “Purpose and legal basis of processing,” each data subject may withdraw at any time any consent given or object to their processing, through a specific request made via email to: privacy@sprech.com

7. RIGHT TO LODGE A COMPLAINT WITH THE SUPERVISORY AUTHORITY

7.1 Furthermore, each data subject may lodge a complaint with the Data Protection Authority in the event that they believe that their rights under the GDPR have been violated, according to the procedures indicated on the Authority’s website, accessible at: www.garanteprivacy.it. The exercise of data subject rights is free of charge.

7.2 Where the person providing data is under 18 years of age, such processing is lawful only if and to the extent that such consent is given or authorized by at least one of the holders of parental responsibility, for whom identifying data and a copy of identification document are acquired.

8. IDENTIFICATION DETAILS OF THE DATA CONTROLLER

Pursuant to Article 4 of EU 679/2016, the Data Controller is SPRECH SRL with registered office at 73025 MARTANO, KM 1.5 Provincial Road MARTANO_SOLETO, in the person of the legal representative pro-tempore. The Data Processor, to whom you can contact to exercise the rights referred to in Art. 12 and/or for any clarification regarding personal data protection can be reached at: privacy@sprech.it.

9. MODIFICATIONS

This information notice may be subject to modifications. Should substantial changes be made to the use of user data by sprech.com, it will notify the user by publishing them prominently on its pages.
